Most state child abuse laws contain
provisions whereby mandatory reporters are immune
from liability. This is usually a complete
immunity from all types of legal actions. If the
reporter files a report according to the child
abuse statute, the reporter is immune whether the
report is true or false, and whether the report is
made in good faith or bad faith. Although nothing
can prevent a lawsuit, the reporter will win on a
motion to dismiss for reporting according to the
state child abuse statute.
